You can apply from inside Canada if one of these applies:
you have a valid study or work permit
your spouse, common-law partner or parent has a valid study or work permit
If you are studying or going to study in Canada in the near future you can apply for an open work permit in Winnipeg, Canada that will allow you work for up to 20 hours per week during class session and fulltime in between sessions and holidays.
b. Your spouse, common-law partner or parent has a valid study or work permit.
If you are in Canada and your above mentioned is studying in Canada for more than 6 months you will qualify to apply for an open work permit in Winnipeg which allows you to work in a full-time capacity with no limitations on where you can work. If your spouse, common-law partner or parent is not in a skilled position then you will not qualify under this program.
C. You are eligible for a post-grad work permit and your study permit is still valid then you are qualified to apply for an open work permit.
The length of time you will receive is based on the length of your studies. If you take a course that is 6 months in length to 1 year you will get a work permit that co-insides with the length of your study. However, if you take studies that are at least equivalent to 1 year 6 months or more you will qualify for a 3-year open work permit. This will allow your spouse or partner to apply for a work permit for the duration of your work permit as well. You must be aware that at the end of your open work permit you still have not qualified for any immigration program like EE or PNP then you will need to apply for a closed work permit and that your spouse, common-law partner will no longer qualify for a work permit.
d. You have a post-grad work permit that has expired or will expire in the next 4 months.
This is a current program that has been implemented because of covid-19 and may will expire later in 2021. This has been put in place for individuals who were on post grad work permits and because of covid-19 they were unable to get the work experience they needed to apply for any of the Permanent Resident program because of lack of work experience. To qualify you must have had a valid work permit that expired in January of 2020 and you did not leave Canada for any period of time up to the release of the program in January 27,2021.
e. You or your spouse, common-law partner has a temporary resident permit that is valid for 6 months or more.
This has also become heavily used since covid-19 pandemic is in Canada because of individuals not being able to leave Canada to their home country and needed to be able to support themselves while in Canada
f. You are waiting for a decision on an application for permanent residence for the following.
In-Canada spousal class (only if your spouse currently has an open work permit. If they have a bridging work permit you will not qualify)
Temporary resident permit holder class. This class is not the same as a work of study or temporary resident visa. This is for persons who are inadmissible and it will state clearly on the permit that it is a TRP.
g. You made or will make a claim for refugee protection.
If you have or planning on filing a refugee claim then you can apply for a open work permit. However, it will take time as an open work permit is only issued once phase 1 of the application has been processed under normal conditions. (covid-19 has made the process different for the time being but will revert to the old process once the pandemic is over)
h. You have been recognized as a convention refugee or protected person by the immigration and refugee board of Canada
You will apply for a work permit upon acknowledgement of you change of status
i. You are allowed to work in Canada without a work permit but you need a work permit for a different job (this does not apply to business visitors).
